DATES: The Spirit Vacations Package Giveaway (the “Giveaway”) begins at 12:00 AM Eastern Daylight Time (“EDT”) on July 5, 2023 and ends at 11:59 PM EDT on July 26, 2023 (the “Giveaway Period”).

ELIGIBILITY: Each Entrant must (a) be a legal permanent resident of one of the fifty (50) United States or the District of Columbia (excluding residents of Rhode Island, New York, and wherever else restricted or prohibited by law), and (b) be at least twenty-one (21) years of age. The Entrants who are selected as the potential prize winners (each, a “Prize Winner”) must have a valid social security number and provide it to the Sponsor (defined below) to report the tax liability associated with acceptance of their prize (the “Prize”). Valid social security numbers will be determined by Internal Revenue Service (“IRS”) requirements as further defined in the “PRIZE CLAIMS” section of these Official Rules.

Employees and their immediate family members (parents, children, siblings, or spouse, regardless of where they live, or persons living in the same household, whether related or not) of Spirit Airlines, Inc. (the “Sponsor”) and its advertising agencies, and any others engaged in the development, production, execution or distribution of this Giveaway, including the Independent Administrator (all of the aforementioned collectively referred to as the “Giveaway Entities”) are not eligible to participate. The Giveaway is subject to all applicable federal, state, and local laws and regulations. By entering this Giveaway, Entrants indicate their full and unconditional agreement to and acceptance of, these Official Rules and the decisions of the Sponsor and/or Independent Administrator, which will be final and binding in all respects. Winning the Prize is contingent upon fulfilling all requirements set forth herein.

HOW TO ENTER: You are automatically entered to win by entering your first name, last name, and email address through the sweepstakes landing page: https://vacations.spirit.com/wl/email/signup/sweepstakes/Myrtle-Beach-Sweeps/ during the Giveaway Period or you may enter by mailing a postcard, with required postage, with the “Spirit Vacations Package Giveaway” followed by Entrant’s first name, last name, phone number, and email address handwritten legibly in block letters and addressed to Spirit Vacation Giveaway, Attn: Guest Services, 2800 Executive Parkway, Miramar, FL 33025, postmarked during the Giveaway Period and arriving at that address within ten (10) days of the end of the Giveaway Period. Postcards arriving after that day, not including all of the foregoing information, or not meeting all foregoing requirements will be disqualified. Limit of one (1) entry per household. Multiple entries submitted by a single person or from a single household will be disqualified. Mechanically produced postcards will be disqualified. Postcards without sufficient postage will not be accepted. The Sponsor will not verify the receipt of entries from Entrants and no notices or confirmation of disqualification will be given. In the event of a dispute regarding the identity of the person who submitted an entry, the entry will be deemed submitted by the Authorized Account Holder (defined below) of the e-mail address. “Authorized Account Holder” is defined as the natural person who is assigned to an e-mail address by the Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. An Entrant may be requested to provide the Sponsor with proof that the Entrant is the Authorized Account Holder of the email address associated with the entry. Any attempt by any Entrant to enter this Giveaway using multiple/different accounts or any other methods may void the Entrant’s entries and may result in disqualification, at the sole discretion of the Sponsor. Use of any automated system to participate in the Giveaway is prohibited and may result in disqualification. The Giveaway Entities are not responsible for any entry that is lost, late, misdirected, or undeliverable, whether due to system errors, omissions, interruptions, deletions, defects, delays in operation or transmissions, or any other reason, theft or destruction, or failures, faulty transmissions or other telecommunication malfunctions, entries not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, technical malfunctions, or otherwise. Late entries or entries sent via any other method than those stated above will not be accepted. The Sponsor will not be responsible for entries that contain an invalid email address and such entries will not be considered eligible for this Giveaway.

WINNING/NOTIFICATION: On or about September 4, 2023, one (1) prize winner to receive the Prize (“Prize Winner”) will be selected from among all eligible entries. The random drawing will be conducted by the Independent Administrator whose decisions are based upon their sole discretion and interpretation of these Official Rules and are final and binding in all respects. The odds of being selected as the Prize Winner are dependent upon the total number of eligible entries received. The potential Prize Winner will be notified by the Independent Administrator via email within one (1) to three (3) business days from the drawing date. The Prize Winner will be required to respond to the email notification within seven (7) days from transmission of notification and, in such timeframe, complete the prize claims and verification process as further described in the “PRIZE CLAIMS” section below. The Independent Administrator will only make two (2) attempts to reach a potential Prize Winner via email. If the Independent Administrator cannot reach a potential Prize Winner after two (2) attempts have been made, that original potential Prize Winner will be disqualified, and an alternate Prize Winner will be selected as outlined above. The Independent Administrator or the Sponsor will make five (5) attempts to confirm a Prize Winner by notifying alternates. If the Independent Administrator has not confirmed a Prize Winner after five (5) attempts have been made, as applicable, the Prize will not be awarded.

PRIZE CLAIMS: Except where prohibited, the Prize Winner will be required to complete, execute and return an Affidavit of Eligibility, Liability and Publicity Release (the “Release”), an IRS Form W-9 and any other documents required by the Sponsor, including a Travel Companion waiver, signed by the Prize Winner’s travel companion (collectively, the “Required Documents”) within seven (7) days or less from receipt of notification from the Independent Administrator by email. If a potential Prize Winner fails to return any of the Required Documents within the time required, the email is returned as undeliverable or is not eligible to win according to these Official Rules, such potential Prize Winner forfeits their right to the Prize and an alternate will be notified as outlined in the “WINNING/NOTIFICATION” section above even if the disqualified potential Prize Winner’s name has been publicly announced. Each potential Prize Winner must report income to the IRS. If it is determined during the verification process that a potential Prize Winner does not have a valid social security number for the Sponsor to report the tax liability associated with acceptance of their Prize, such potential Prize Winner will be disqualified, and an alternate will be notified as outlined above. Valid social security numbers will be determined by IRS requirements. If it is determined by the Independent Administrator, in its sole discretion, that a potential Prize Winner is not eligible or otherwise not in compliance with these Official Rules, the potential Prize Winner forfeits their right to the Prize and an alternate will be selected as outlined in the “WINNING/NOTIFICATION” section above, even if the disqualified potential Prize Winner’s name may have been publicly announced. In the event a potential Prize Winner is disqualified for any reason, the Sponsor and Independent Administrator shall have no liability or obligation to such individual.

PRIZE: There will be one (1) Prize. The Prize Winner will receive a three (3) night oceanfront hotel stay for two (2) adults in Myrtle Beach, SC; two (2) tickets to two (2) area attractions, a $100 gift certificate to a local area restaurant, as well as airfare for the Prize Winner and a companion on Spirit Airlines from any of the 16 nonstop services to Myrtle Beach International Airport, Myrtle Beach, SC (MYR). While subject to change and schedule, Spirit Airlines presently serves nonstop routes to MYR from ACY, BDL, BOS, CLE, DTW, EWR, FLL, LBE, LGA, MCO, MHT, PHL, PIT, and ROC.

The approximate retail value (“ARV”) of the Prize is two thousand five, hundred dollars ($2,500).

The PrizeWinner along with their companion will be responsible for securing any transportation to/from the applicable airports, transportation in Myrtle Beach, and any costs not covered by the Prize, and will be responsible for booking their flights using the provided voucher. Each voucher includes one (1) carry-on item (item priority boarding), one (1) checked bag, one (1) personal item, and one (1) coach class seat. Upgraded seats may be available for purchase on Spirit.com or at the airport in advance of departure at the Prize Winner’s sole cost. Any other fees, including fees for additional services, and government-imposed fees and tax, will be due from the Prize Winner.

Vouchers must be used and all travel completed within six (6) months of the Prize award date or the Prize will be forfeited. Restrictions apply on peak travel dates, holidays, and based on availability. Travel dates are subject to the Sponsor’s approval. The trip must be booked at least thirty (30) days prior to the departure date.

If the Prize Winner elects to partake in any or all portions of their Prize, but not other portions, or declines any portion of the Prize, the Prize will be awarded but any unused portion of the Prize will be forfeited and shall not be subject to further or alternative compensation. Unless a child or ward of the Prize Winner, the second ticket obtained with the voucher must be for a companion that is eighteen (18) years of age or older as of the date of departure. The second voucher may only be redeemed for a ticket with the same itinerary and at the same time as the Prize Winner. The ARV of the Prize may vary depending on the points of departure and/or airline fare fluctuations. Any difference between the stated ARV and the final ARV of the Prize will not be awarded. Each Prize consists only of the elements expressly set forth above; no other elements or expenses (including, without limitation, extra hotel services or other or extended stay, insurance, meals, ground transportation, phone calls, baggage, gratuities, incidentals, souvenirs, gasoline, etc.) are included in the Prize and all such expenses are the sole responsibility of the Prize Winner. The Prize Winner is responsible for any air travel taxes and/or expenses, including applicable departure taxes or fees, inspection charges, baggage fees, and security charges. The Prize Winner and their companion are responsible for obtaining, at their own expense, any necessary travel documentation (e.g., valid photo identification, visas, passports, etc.) prior to travel. Once issued, tickets are non-transferable and may not be reissued once travel has commenced. Open tickets may not be issued and stopovers are not permitted.

The Prize Winner and their companion should be aware of and comply with government guidelines regarding travel restrictions and mandatory quarantines before traveling. Please note that any public location where people are present provides an inherent risk of exposure to COVID-19, and the Sponsor cannot guarantee that any person will not be exposed during travel.

The Prize Winner may not assign or transfer any part of their Prize to another person. No refund or compensation will be made in the event of the cancellation or delay of any flight.

All transportation by air will be subject to the applicable carrier’s contract of carriage and will not be governed by these Official Rules.

The value of the Prize is taxable as income to the Prize Winner and the Prize Winner is solely responsible for any taxes, including, but not limited to, all applicable federal, state, and local taxes that become due for the value of the Prize. The Sponsor, or a third party acting on its behalf, may be required to report the value of the Prize to the Internal Revenue Service in the year the Prize is received by the Prize Winner; and, in such case, the value of the Prize will be reported to the Prize Winner and the Internal Revenue Service in the form of a Form 1099 and/or other applicable tax forms.

There is a limit of one (1) Prize per person/household for the Giveaway.

GENERAL RULES OF PARTICIPATION: By participating in this Giveaway, Entrants, potential Prize Winners, and the Prize Winner (a) release each and all of the Giveaway Entities, from any and all liability, damages, or causes of action (however named or described) for or arising out of participation in the Giveaway, and/or the receipt or use/misuse of the Prize awarded, including, without limitation, liability for personal injury, death or property damage; and (b) agree to be bound by these Official Rules and the decisions of the Sponsor or Independent Administrator, which are final in all respects and not subject to appeal. The Sponsor reserves the right to permanently disqualify from this Giveaway any Entrant or Prize Winner it believes has violated these Official Rules. The Sponsor may prohibit an Entrant from participating in the Giveaway or winning the Prize if, in its sole discretion, it determines that said Entrant is attempting to undermine the legitimate operation of the Giveaway by cheating, hacking, deception, or other unfair playing practices or intending to annoy, abuse, threaten or harass any other Entrants, the Sponsor, or the Giveaway Entities. If for any reason this Giveaway is not able to be conducted as planned, including, but not limited to, by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, or any other causes beyond the reasonable control of the Sponsor or the Independent Administrator which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Giveaway, then the Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Giveaway. To the fullest extent permitted by law, Entrants covenant not to sue any Giveaway Entity or cause them to be sued regarding any matter released above; and further covenant not to disaffirm, limit or rescind any releases. A waiver by one or more of the Giveaway Entities of any term in these Official Rules does not constitute a waiver of any other provision. CAUTION: ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND, SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. THE SPONSOR’S FAILURE TO ENFORCE ANY TERM OF THESE OFFICIAL RULES SHALL NOT CONSTITUTE A WAIVER OF THESE PROVISIONS.

NO LIABILITY: By participating, Entrants and the Prize Winner agree to release, discharge, indemnify and hold harmless the Sponsor, the Giveaway Entities, and each of their respective officers, directors, employees, representatives, and agents from and against any claims made by or through them related in any way to the operation of this Giveaway as well as any other claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from receipt, acceptance, possession, misuse or use of the Prize; participation in any Giveaway-related activity; or participation in this Giveaway.

DISPUTES: Entrants and the Prize Winner agree that any and all disputes, claims, and causes of action arising out of or connected with the Giveaway or any Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Florida. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, an Entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Giveaway, shall be governed by and construed in accordance with the laws of Florida, without giving effect to any choice of law or conflict of law rules (whether of Florida or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Florida.

PRIVACY: Personal information collected in connection with this Giveaway will be used only in accordance with the Sponsor’s privacy policy, as amended from to time. The Sponsor’s privacy policy may be viewed here: https://content.spirit.com/Shared/en-us/Documents/Privacy_Policy.pdf.

WINNER’S LIST REQUEST: For the name of the Prize Winner or a copy of these Official Rules, please submit a request handwritten in block letters and a self-addressed and stamped envelope by December 31, 2023 to Spirit Vacation Giveaway, Attn: Guest Services, 2800 Executive Parkway, Miramar, FL 33025.
